Terms of Service

1. Acceptance of Terms
By accessing or using MOD Platform ("Service") operated by MOD Tech Labs ("Company," "we," "us"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Description of Service
MOD Platform is a visual computing pipeline platform that provides:
- File upload, storage, and management
- Visual processing workflows (image, 3D, video, audio processing)
- Worker management for distributed computing
- API access for automation
3. Accounts and Registration
- You must provide accurate registration information
- You are responsible for maintaining the security of your account credentials
- You must be at least 18 years old to use the Service
- We ask that each person or entity maintain a single account. Each registration requires a unique email address.
4. Data Ownership
- Your Data: You retain all rights to data you upload to the Service. We do not claim ownership of your content.
- Processing: When you run workflows, your data is processed by containerized applications. We access file metadata (size, type, format) and generate resource usage metrics for scheduling optimization. Some processing nodes inspect file content (e.g., thumbnail generation, blur detection, format analysis).
- Performance Data: We collect performance metrics (CPU usage, duration, resource curves) to improve our scheduling algorithms. These metrics are associated with your tenant record for scheduling and billing purposes; they contain no file content.
5. Acceptable Use
You may not use the Service to:
- Process illegal content
- Distribute malware or malicious code
- Attempt to access other users' data
- Circumvent usage limits or billing
- Resell the Service without written agreement
6. Billing and Payment
- Plans are billed monthly. Prices are listed on our pricing page.
- Upgrades take effect immediately with prorated charges.
- Downgrades take effect at the next billing cycle. No fixed grace period applies to usage above the new plan's limits; excess usage is handled under your plan terms.
- Failed payments trigger a grace period of 7 days on monthly-billed plans and 14 days on annual and enterprise plans, as stated in the payment-failure notice. After that, accounts are downgraded to the free tier.
- Credits renew monthly and do not roll over.
7. Service Level
- We target 99.9% uptime but do not guarantee it.
- Scheduled maintenance windows will be communicated in advance.
- We are not liable for downtime caused by force majeure, third-party service failures, or customer infrastructure issues.
8. Termination
- You may cancel your subscription at any time from the billing page.
- We may terminate accounts that violate these Terms with notice.
- Upon termination, your account is deactivated (soft-deleted) and your files and keys are destroyed by our privacy-erasure process after a grace period. Some record rows are retained and are not subject to hard deletion (see Section 5, Data Retention, of our Privacy Policy).
9. Data Protection, Subprocessors, and Transfers
- We describe how we collect, use, and retain personal data in our Privacy Policy.
- Third-party processors we use (subprocessors) are listed on our Subprocessor List page, including regions and how each data path can be disabled.
- Where applicable, transfers of data to subprocessors in other jurisdictions are made under contractual safeguards, including Standard Contractual Clauses (SCCs).

10. Limitation of Liability
THE SERVICE IS PROVIDED "AS IS." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.
11. Changes to Terms
We may update these Terms. Continued use after changes constitutes acceptance. Material changes will be communicated via email.
